PROCEDURE OF TRADEMARK REGISTRATION

1. Trademark Search – First step in the process of Trademark Application is to search the proposed Brand Name and logo at the IPR portal in order to confirm that the proposed brand name is available for registration
2. Trademark Application – File trademark application at the IPR Portal after filling following details
   • Class applicable i.e. if footwear application then Class 25
   • Applicant Details i.e name of Proprietor, Address etc
   • Brand Name
   • Logo attach with the application
   • Description of Product or Services
3. Accepted or Objected- once a trademark application is filed then it is process at the Trademark office. The examiner either accepts or raise objections. If accepted then it will be advertise in the Trademark Journal for 4 months
4. If objection is raised then reply is file within 30 days
5. Once an application is Accepted and advertise it remains in the Trademark journal for 4 months
6. If no opposition is raised during 4 months then it is sent for final issuance of Registration Certificate.
   • Registration Certificate is valid for 10 Years
   • After 10 years, renewal application of Trademark is file
